General terms and conditions of sale

PREAMBLE

  1. The present conditions apply to all reservations made with the company LES TERRASSES DE KERGROADEZ operating the hotel restaurant LE CASTEL AC’H in Plouguerneau. They cannot be used for reservations made through a retailer of LES TERRASSES DE KERGROADEZ (ex Booking.com, Expedia, Wonderbox, Groupon, …) except for points VII – VIII- IX- X – XI & XII which are valid for all customers staying in the establishment.
  2. For all reservations made through a LES TERRASSES DE KERGROADEZ retailer, please refer to the retailer’s General Terms and Conditions of Sale.
  3. The customer declares that he/she has full legal capacity to enter into the present terms and conditions.
  4. The customer’s agreement to the general terms and conditions of sale and the terms and conditions of sale of the fare booked is obtained at the time of booking; no booking is possible without this agreement.
  5. Customers can save and edit these terms and conditions using the standard functions of their browser or computer.

I. RESERVATION

  1. Prices quoted remain firm until the option date.
  2. Reservations become final only on receipt of the deposit paid for the service. The amount of the deposit varies according to the service offered.
  3. No reservation can be taken into account without payment of a deposit or communication of the unique code of a gift voucher.
  4. Reservations cannot be taken into account without a credit card number and its validity date (it is specified that the credit card used must be valid at the time of the stay) and the visual cryptogram.
  5. Reservations cannot be taken into account without a valid e-mail address. The latter is used to communicate the details of the reservation and the General Sales Conditions relating to the reservation.

II. RATES

  1. Prices are given in Euros. VAT is always included. The prices indicated include only the services strictly mentioned in the reservation. Any additional services provided by the hotelier during the stay and, if applicable, the tourist tax will be added to the price mentioned in the reservation.
  2. The prices applicable are those in force on the day of booking. As independent professionals, hoteliers are free to vary their prices at any time. Therefore, the price displayed during a visit to our website is only valid for orders taken during the period in which it is displayed. Only the price indicated on the booking confirmation is binding.
  3. Best rate guaranteed” – After booking a room on castelach.fr, and within a maximum of 24 hours, the difference in rate may be reimbursed if the rate observed with another e-distributor (e.g. Booking, Hotels.com, Expedia, Trivago…), for the same date and strictly identical stay conditions (same room, same duration, same options, same cancellation conditions, etc…) is lower. It is the customer’s responsibility to provide proof of this lower rate. If the rate applied on the castelach.fr website is the same or lower, the refund cannot be made.

III. BOOKING CONDITIONS

A. General terms and conditions

  1. Your credit card number and its validity date (please note that the credit card used must be valid at the time of booking) and the visual cryptogram will be requested at the time of booking.
  2. As a deposit, 30% of the total amount of the stay indicated at the time of booking is debited from the credit card provided at the time of booking.
  3. A bank authorization request may be made on your credit card. The amount cannot exceed the amount shown on your confirmation. The authorization request is not an immediate debit, but corresponds to a reserve for future payment, authorized by the customer’s bank, which temporarily reduces the ceiling of the bank card used to guarantee the possibility of a future debit. In some cases, however, the authorization request may appear as a pending debit on the bank account associated with the card used.

B. Special offers

  1. Your credit card number and its validity date (please note that the credit card used must be valid at the time of booking) and the visual cryptogram will be requested at the time of booking.
  2. The total cost of the accommodation indicated at the time of booking will be debited from the credit card provided at the time of booking. Excludes tourist taxes.

C. Special case of package holidays

  1. Your credit card number and its validity date (please note that the credit card used must be valid at the time of booking) and the visual cryptogram will be requested at the time of booking.

  2. The services ordered by means of a card will be those mentioned on the said gift voucher.
  3. Your credit card number and its validity date (please note that the credit card used must be valid at the time of booking) and the visual cryptogram will be requested at the time of booking.
  4. In the case of a reservation with a valuable gift voucher, and if the value of this gift voucher is not fully used during the stay, the customer will not be entitled to a refund of the balance. The remainder remains valid for future services until the end of the gift voucher’s validity.

E. Special case of “gift voucher” bookings

  1. Gift voucher holders must quote the unique code shown on their gift voucher at the time of booking.
  2. Your credit card number and its validity date (please note that the credit card used must be valid at the time of booking) and the visual cryptogram will be requested at the time of booking.
  3. If the value of the gift voucher is not used up during the stay, the customer will not be entitled to a refund of the balance. The remainder remains valid for future services until the end of the gift voucher’s validity.

F. Special case of “Soirée Etape” bookings

  1. Except in exceptional circumstances, this formula is valid from Monday to Thursday. Soirée Etape rates are preferential rates for business travelers, so a business card may be required.
  2. Soirée Etape” only applies to business stays with single room occupancy.
  3. Your credit card number and its validity date (please note that the credit card used must be valid at the time of booking) and the visual cryptogram will be requested at the time of booking.
  4. A bank authorization request may be made on your credit card. The amount cannot exceed the amount shown on your confirmation. The authorization request is not an immediate debit, but corresponds to a reserve for future payment, authorized by the customer’s bank, which temporarily reduces the ceiling of the bank card used to guarantee the possibility of a future debit. IV. CANCELLATION AND MODIFICATION CONDITIONS

A. General terms and conditions

  1. For accommodation services (reservation of rooms in an establishment or other types of accommodation), customers are reminded that they do not have the right of withdrawal provided for in article L. 221-18 of the French Consumer Code, and this in accordance with article L. 221-28 paragraph 12 of the French Consumer Code, which excludes this right for contracts relating to the provision of accommodation services which must be supplied on a specific date or at a specific time.
  2. Prices may be revised upwards in the event of a request to change the dates of stay, or the type or quality of service. The deposit will be applied to the new reservation. In the event of an increase in the initial price, an additional deposit will be debited, up to a maximum of 30% of the estimated total cost of the service. Any request for modification must be made in writing (e-mail or post). Any modification is deemed valid only after written agreement from the establishment.
  3. Regardless of the cancellation period, deposits are non-refundable.
  4. All cancellation requests must be made in writing (e-mail or post). The date of the request (date of e-mail or postmark) will be used to calculate the cancellation period.
  5. You can cancel your reservation up to 7 days before arrival. After this time, the first night will be charged to your credit card. Any deposit paid is not deducted from this amount.
  6. In the event of a no-show, the total cost of the accommodation will be deducted from the card provided at the time of booking, less any deposit paid.
  7. If the service is interrupted for reasons for which the customer is responsible (e.g. early departure), the full agreed price will be collected.
  8. Cancellation of a reservation for a service booked online can be made directly on the site via the “Consult or cancel your reservation” section of the online reservation platform.
  9. Reservations for services may be changed or cancelled directly with the establishment, whose telephone and other contact details are specified on the e-mail confirmation of the reservation.

B. Special offers

  1. – For accommodation services (reservation of rooms in an establishment or other types of accommodation), the customer is reminded that he/she does not have the right of withdrawal provided for in article L. 221-18 of the French Consumer Code, in accordance with article L. 221-28 paragraph 12 of the French Consumer Code, which excludes this right for contracts for accommodation services to be provided on a specific date or period.
  2. Irrespective of the cancellation period, all sums paid are non-refundable.
  3. In the event of interruption of the service due to the customer’s fault (e.g. early departure), in the case of reservations with prepayment before the stay, no refund will be granted.

C. Special case of package holidays

  1. – For accommodation services (reservation of rooms in an establishment or other types of accommodation), the customer is reminded that he/she does not have the right of withdrawal provided for in article L. 221-18 of the French Consumer Code, in accordance with article L. 221-28 paragraph 12 of the French Consumer Code, which excludes this right for contracts for accommodation services to be provided on a specific date or period.
  2. Regardless of the cancellation period, deposits are non-refundable.
  3. You can cancel your reservation up to 7 days before arrival. After this deadline, the total cost of your stay will be charged to your credit card, less any deposit paid.
  4. In the event of a no-show, the total cost of the stay will be charged to the card provided at the time of booking, less any deposit paid.

G. Force majeure

  1. Force majeure is defined as any unforeseeable and insurmountable event beyond the control of the parties that prevents either the customer or the hotelier from fulfilling all or part of the obligations under the contract. This applies in particular in the event of strike, insurrection, riot, or prohibitions imposed by governmental or public authorities.
  2. It is expressly agreed that force majeure suspends the parties’ performance of their mutual obligations, and that each party shall bear the costs arising therefrom. In particular, customers are solely responsible for any additional costs that may be incurred to enable the trip to continue, following the occurrence of a case of force majeure.
  3. Any deposit paid at the time of booking will be retained and may be used for a new service within a maximum period of 18 months.
  4. In the event of force majeure or any other exceptional event that prevents the service from being carried out, and in particular the reserved room in the establishment from being made available to the Customer, the establishment may reserve the right to accommodate the Customer, in whole or in part, in an establishment of an equivalent category, or to carry out a service of the same nature, subject to the Customer’s prior agreement.

V. GIFT CARDS AND VOUCHERS

Offers are valid for a period specified by the establishment at the time of purchase. The validity period begins on the date of purchase and not on the date of reservation on the site.
The offer is purchased by the customer. However, the latter is not necessarily the beneficiary.
A reservation, subsequent to purchase, is required to use the offer.
Reservations must be made within the period of validity of the offer. However, once this first condition has been met, the date of the stay can be outside this same validity period.
The beneficiary, armed with the unique code relating to the offer purchased, must reserve the service by contacting the establishment. The establishment is in no way responsible for booking services.
The establishment reserves the right to set the dates of availability of services. These are available for consultation at the time of booking.
If this validity period is exceeded, the offer is non-refundable and will be considered as acquired by the establishment.
From 90 days before the expiry date, you can extend the validity of your gift voucher by 30 days for an additional fee. To do so, log in to the link on your gift voucher.

VI. CANCELLATION INSURANCE

The Hotel offers its customers the option of taking out a “Cancellation Insurance” contract with its partner Gritchen Affinity – 27, rue Charles Durand – CS70139 – 18021 Bourges Cedex (the Insurer).

In this case, the Hotel proposes to put the Customer in contact with the Insurer for a subscription via the online reservation platform or at the time of reservation by e-mail, post or telephone. The amount of the subscription is collected by the Hotel at the time of booking and paid to the Insurer.

Claims are managed between the customer and the insurer via the dedicated website https://www.declare.fr/.

The insurance offered allows you to be reimbursed for the cost of your stay in the event of unforeseen circumstances before your trip.

VII. RESTAURANT

  1. Reservations for the restaurant can be made by telephone, e-mail or via the online reservation module on the castelach.fr website.
  2. Your credit card number and its validity date (please note that the credit card used must be valid at the time of booking) and the visual cryptogram will be requested at the time of booking.
  3. A bank authorization request may be made on your credit card. The fee for this authorization request is €30.00 per cover. The authorization request is not an immediate debit, but corresponds to a reserve for future payment, authorized by the customer’s bank, which temporarily reduces the ceiling of the bank card used to guarantee the possibility of a future debit. In some cases, however, the authorization request may appear as a pending debit on the bank account associated with the card used.
  4. The number of place settings must be specified at least 24 hours before the arrival of the participants.
  5. In the event of a reduction in the number of places 24 hours before the arrival of participants, the establishment reserves the right to debit the bank imprint deposited via the online reservation module with the fixed amount of €30.00 per place cancelled on the credit card provided as a guarantee.
  6. In the event of a no-show, the establishment reserves the right to debit the bank imprint deposited via the online reservation module or a flat-rate amount of €30.00 for each item of cancelled cover from the credit card provided as a guarantee.

VIII. ANIMALS

Small pets (under 15kg) are allowed in the hotel (with an extra charge of €25.00 per night) provided they are kept on a leash in and around the premises. They are not allowed in the catering areas.

IX. STAYS & ROOMS

  1. In application of the regulations in force in certain countries, the customer may be asked to fill in a police form on arrival at the hotel. To do this, customers will be asked to show proof of identity to verify whether or not they need to complete the police form.
  2. The customer accepts and undertakes to use the room with due care. Any behavior contrary to public decency and order will lead the hotelier to ask the customer to leave the establishment without any compensation or refund if payment has already been made. If no payment has yet been made, the customer must pay the price of the nights consumed before leaving the establishment.
  3. Rooms are available from 4 p.m. on the day of arrival and must be vacated by 11 a.m. on the day of departure.
  4. The entire establishment is non-smoking. Customers are asked to respect this rule, particularly in bedrooms. In the event of non-compliance with this rule, a flat-rate charge of €300.00 will be debited from the credit card provided at the time of booking.
  5. In the event of damage to furniture or theft, the establishment reserves the right to debit a fixed amount of €500.00 from the credit card provided at the time of booking.
  6. The hotel offers WIFI access for guests to connect to the Internet. The customer undertakes to ensure that the computer resources made available by the hotel will not be used in any way for the purpose of reproducing, representing, making available or communicating to the public works or objects protected by copyright or by a related right, such as texts, images, photographs, musical works, audiovisual works, software and video games, without the authorization of the holders of the rights provided for in Books I and II of the Intellectual Property Code, where such authorization is required. Should the customer fail to comply with these obligations, he or she may be charged with counterfeiting (article L.335-3 of the French Intellectual Property Code), punishable by a fine of 300,000 euros and three years’ imprisonment. The customer is also obliged to comply with the security policy of the hotel’s Internet service provider, including the rules governing the use of security measures implemented to prevent the unlawful use of IT resources, and to refrain from any action that undermines the effectiveness of these measures.

X. RESERVED ACCESS

Access to certain parts of the facility may be restricted. Information is available at reception.

XI. LOCATION

In the event of exceptional circumstances or the impossibility of making the reserved room available to the customer, or in the event of force majeure, the establishment reserves the right to accommodate the customer in whole or in part in a hotel of an equivalent category, for services of the same nature and subject to the prior agreement of the customer. Any additional costs for the room, transport between the two hotels and a telephone call remain the responsibility of the establishment.

XII. RETURNS FORGOTTEN PERSONAL EFFECTS

Personal effects will be sent via our partner Lhost. If personal effects are forgotten, the customer will be informed by e-mail of the possible return details and will process the return with our partner Lhost.

XIII. CLAIMS

Complaints relating to the non-performance or poor performance of hotel services must, to facilitate their processing, be brought to the attention of the company LES TERRASSES DE KERGROADEZ in writing within eight days after the date of departure from the hotel directly to the hotel or to the Customer Service contact details given below. After having contacted the service (after-sales, after travel…) and in the absence of a satisfactory response or in the absence of a response within 60 days, the customer may refer the matter free of charge to the Tourism and Travel Ombudsman, whose contact details and referral procedures are available on his website : www.mtv.travel
